สำหรับการลงทะเบียนเข้าพัก “โรงแรม” ในฐานะผู้ควบคุมข้อมูลส่วนบุคคล จะทำการเก็บรวบรวมข้อมูลของท่าน ได้แก่ ชื่อ-นามสกุล, เลขประจำตัวประชาชน/เลขหนังสือเดินทาง, อีเมล, หมายเลขโทรศัพท์, ระยะเวลาเข้าพัก, หลักฐานการโอนเงิน, ข้อมูลบัตรเครดิต    นอกจากนี้ ทางโรงแรม มีหน้าที่ต้องเก็บรวบรวมข้อมูลส่วนบุคคลของท่านเพื่อรายงานกรมการปกครองโดยจะทำการเก็บรวบรวมข้อมูลตามแบบฟอร์ม รร.3 และ รร 4 และยังมีหน้าที่รายงานต่อสำนักงานตรวจคนเข้าเมืองจึงต้องจัดเก็บตามแบบ ตม. 30 ด้วย โดยข้อมูลดังกล่าวจะถูกนำไปใช้เพื่อวัตถุประสงค์ของการลงทะเบียนเข้าพักและปฏิบัติหน้าที่ตามที่กฎหมายกำหนดไว้ โดยทางโรงแรมจะจัดการข้อมูลของท่านด้วยความระมัดระวัง และตระหนักถึงการให้ความคุ้มครองข้อมูลส่วนบุคคลของท่านด้วยมาตรการรักษาความปลอดภัยที่เหมาะสม ไม่น้อยกว่าระดับที่กฎหมายกำหนด หากความสัมพันธ์ตามสัญญาสิ้นสุดลง ทางโรงแรมจะทำการลบข้อมูลนี้ภายหลังสิ้นสุดความจำเป็นตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูล เมื่อครบกำหนดระยะเวลา 5 ปี    ทั้งนี้ ภายใต้หลักการและรายละเอียดเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลตามประกาศการคุ้มครองข้อมูลส่วนบุคคลที่กฎหมายกำหนด

CCTV Privacy Notice

Prom Ratchada Hotel (Golden Property Plus Co., Ltd.) and Prom Hotel (Millionaire Building Co., Ltd.) are operating CCTV for monitoring inside and around the head office (“the Area”) of the company to protect the lives, health, and property of our staff. The company collects personal data of officers, employees, customers, contact persons, or any individuals (collectively referred to as “you”) who enter the Area through the use of the aforementioned CCTV equipment.

This CCTV Privacy Notice (“Notice”) provides information about the collection, use, or disclosure of information that can identify you (“Personal Data”), as well as your various rights, as follows:

1. Legal Basis for Personal Data Processing

The company collects your personal data based on the following legal grounds:

❒ Necessity for preventing or suppressing danger to your life, body, or health or that of another person.

❒ Necessity for the legitimate interests of the company or another person, where such interests are not less important than your fundamental rights to personal data.

❒ Necessity for compliance with relevant laws governing safety and the working environment, and the company’s property.

2. Purposes for Collecting Your Personal Data

The company collects your personal data for the following purposes:

(1) For the protection of your personal health and safety, including your property.

(2) For the protection of the company’s buildings, facilities, and property from damage, obstruction, destruction of property, or other crimes.

(3) To support relevant law enforcement agencies for the deterrence, prevention, investigation, and prosecution of legal cases.

(4) To assist in the dispute resolution process that occurs during disciplinary or grievance procedures.

(5) To assist in investigation processes or processes related to handling complaints.

(6) To assist in the initiation or prevention of civil lawsuits, including but not limited to legal actions related to employment.

3. Personal Data Collected and Used by the Company

In accordance with the purposes stated in item 2, the company installs CCTVs in visible locations and places warning signs indicating the use of CCTVs at entrances and exits, as well as in areas where the company deems it necessary to monitor, to collect your personal data when you enter the Area, as follows:

The company will not install CCTVs in areas that may unreasonably infringe upon your fundamental rights, such as hotel rooms, bathrooms, shower rooms, or employee lounges.

4. Disclosure of Your Personal Data

The company will keep the CCTV data related to you confidential and will not disclose it, except when the company deems it necessary to achieve the monitoring purposes stated in this notice. The company may disclose CCTV data to the following types of individuals or legal entities:

(1) Authorities with legal power to assist and support law enforcement, or for investigations or legal proceedings.

(2) Third-party service providers for the necessity of ensuring the prevention or suppression of danger to your life, body, health, and property or that of another person.

(3) Others (if any).

5. Rights of the Data Subject

The Personal Data Protection Act B.E. 2562 (2019) aims to give you more control over your personal data. You can exercise your rights under the Personal Data Protection Act B.E. 2562 (2019) when the provisions regarding the rights of the data subject come into force, which are as follows:

(1) The right to access, receive a copy, and request disclosure of the source of your personal data collected by the company, except in cases where the company has the right to refuse your request according to the law or court order, or in cases where your request may cause damage to the rights and freedoms of others.

(2) The right to request correction of your inaccurate or incomplete personal data to be accurate, current, complete, and not misleading.

(3) The right to request the suspension of the use of your personal data in any of the following cases:

3.1 During the period when the company is verifying your request to correct your personal data to be accurate, complete, and current.

3.2 Your personal data was collected, used, or disclosed unlawfully.

3.3 When your personal data is no longer necessary for the purpose for which the company collected it, but you wish the company to retain it for the purpose of exercising your legal rights.

3.4 During the period when the company is proving to you the legal grounds for collecting, using, or disclosing your personal data, or verifying the necessity of collecting, using, or disclosing your personal data for public interest, due to your objection to the collection, use, or disclosure of your personal data.

(4) The right to object to the collection, use, or disclosure of your personal data, except in cases where the company has legal grounds to refuse your request (e.g., the company can demonstrate that the collection, use, or disclosure of your personal data has more legitimate grounds, or for the establishment of legal claims, compliance with or exercise of legal claims, or for the public interest in the company’s mission).

6. Personal Data Retention Period

To fulfill the purpose of monitoring by using CCTV equipment as specified in this notice, the company will retain the personal data in the CCTV related to you for a period of approximately 10 days after the building staff has completed the retrospective check. This period is in accordance with the company’s storage standards. After this period, the company will delete or destroy your personal data.

7. Personal Data Security Measures

The company has appropriate technical and administrative security measures for your personal data to prevent loss or unauthorized access, deletion, destruction, use, modification, editing, or disclosure of personal data, in accordance with the company’s Information Security Policy.

In addition, the company has established a personal data protection policy and announced it throughout the organization, along with guidelines for secure collection, use, or disclosure of personal data, maintaining confidentiality, integrity, and availability of personal data. The company will review this policy and this notice at appropriate intervals.

8. Responsibilities of the Data Controller

The company has designated only specific officers with the authority to collect, use, or disclose personal data for this processing activity who can access your personal data. The company will ensure that these officers strictly comply with this notice.

9. Changes to the Privacy Notice

In the event of an update or change to this notice, the company may consider and amend it as appropriate and will notify you through the channel https://www.promratchada.com with the date of the latest version at the end. However, the company recommends that you regularly check for new notices, especially before you enter the company’s premises. Your entry into the Area is considered an acknowledgment of the terms in this notice. Therefore, please refrain from entering the Area if you do not agree with the terms in this notice. If you continue to enter the Area after this notice has been amended and published through the aforementioned channel, it will be considered that you have acknowledged the changes.

 โรงแรมพร้อม รัชดา  (บริษัท โกลด์เด้น พร็อพเพอร์ตี้ พลัส จำกัด )  และ โรงแรมพร้อม  (บริษัท มิลเลียนแนร์ บิลดิ้ง จำกัด )  กำลังดำเนินการใช้กล้องวงจรปิด (CCTV) สำหรับการเฝ้าระวังสังเกตการณ์ในพื้นที่ภายใน และรอบบริเวณ สำนักงานใหญ่(“พื้นที่”) ของบริษัทฯ เพื่อการปกป้องชีวิต สุขภาพ และทรัพย์สิน   ทั้งนี้ บริษัทฯ ทำการเก็บรวบรวมข้อมูลส่วนบุคคลของเจ้าหน้าที่ ผู้ปฏิบัติงาน ลูกค้า ลูกจ้าง  ผู้มาติดต่อ หรือ บุคคลใด ๆ (รวมเรียกว่า“ท่าน”) ที่เข้ามายังพื้นที่ โดยผ่านการใช้งานอุปกรณ์กล้องวงจรปิดดังกล่าว

ประกาศความเป็นส่วนตัวในการใช้กล้องวงจรปิด (“ประกาศ”) ฉบับนี้ให้ข้อมูลเกี่ยวกับการดำเนินการเก็บรวบรวม ใช้หรือเปิดเผย ซึ่งข้อมูลที่สามารถทำให้สามารถระบุตัวท่านได้ (“ข้อมูลส่วนบุคคล”) รวมทั้งสิทธิต่าง ๆ ของท่าน ดังนี้

 1. ฐานกฎหมายในการประมวลผลข้อมูลส่วนบุคคล

       บริษัทฯดำเนินการเก็บรวบรวมข้อมูลส่วนบุคคลของท่านภายใต้ฐานกฎหมายดังต่อไปนี้

❒ ความจำเป็นในการป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของท่านหรือบุคคลอื่น

❒ ความจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯหรือบุคคลอื่น โดยประโยชน์ดังกล่าวมีความสำคัญ    ไม่น้อยไปกว่าสิทธิขั้นพื้นฐานในข้อมูลส่วนบุคคลของท่าน

❒ ความจำเป็นในการปฏิบัติตามกฎหมายที่เกี่ยวข้อง ซึ่งควบคุมดูแลเกี่ยวกับความปลอดภัยและสภาพแวดล้อมในสถานที่ทำงาน และทรัพย์สินของบริษัทฯ

2. วัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคลของท่าน

       บริษัทฯดำเนินการเก็บรวบรวมข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ ดังต่อไปนี้

      (1)เพื่อการปกป้องสุขภาพและความปลอดภัยส่วนตัวของท่าน ซึ่งรวมไปถึงทรัพย์สินของท่าน

      (2)เพื่อการปกป้องอาคาร สิ่งอำนวยความสะดวกและทรัพย์สินของบริษัทฯจากความเสียหาย   การขัดขวางการทำลายซึ่งทรัพย์สินหรืออาชญากรรมอื่น 

     (3)เพื่อสนับสนุนหน่วยงานที่เกี่ยวข้องในการบังคับใช้กฎหมายเพื่อการยับยั้ง ป้องกัน สืบค้น และ ดำเนินคดี ทางกฎหมาย

     (4)เพื่อการให้ความช่วยเหลือในกระบวนการระงับข้อพิพาทซึ่งเกิดขึ้นในระหว่างที่มีกระบวนการทางวินัยหรือกระบวนการร้องทุกข์

     (5)เพื่อการให้ความช่วยเหลือในกระบวนการสอบสวน หรือ กระบวนการเกี่ยวกับการส่งเรื่องร้องเรียน

     (6)เพื่อการให้ความช่วยเหลือในกระบวนการริเริ่มหรือป้องกันการฟ้องร้องทางแพ่ง ซึ่งรวมไปถึงแต่ไม่จำกัดเพียงการดำเนินการทางกฎหมายที่เกี่ยวข้องกับการจ้างงาน  

3.ข้อมูลส่วนบุคคลที่บริษัทฯเก็บรวบรวมและใช้

    ตามวัตถุประสงค์ตามที่ได้แจ้งในข้อ 2. บริษัทฯทำการติดตั้งกล้องวงจรปิดในตำแหน่งที่มองเห็นได้ โดยจะจัดวางป้ายเตือนว่ามีการใช้งานกล้องวงจรปิด ณ ทางเข้าและทางออก รวมถึงพื้นที่ที่บริษัทฯเห็นสมควรว่าเป็นจุดที่ต้องมีการเฝ้าระวัง เพื่อเก็บรวบรวมข้อมูลส่วนบุคคลของท่านเมื่อท่านเข้ามายังพื้นที่ ดังต่อไปนี้

·         ภาพนิ่ง

·         ภาพเคลื่อนไหว

·         ภาพทรัพย์สินของท่าน(ถ้ามี) เช่น โทรศัพท์มือถือ คอมพิวเตอร์โน๊ตบุ๊ค ยานพาหนะ กระเป๋า  เป็นต้น

·         อื่นๆ    

ทั้งนี้ บริษัทฯจะไม่ทำการติดตั้งกล้องวงจรปิดในพื้นที่ที่อาจล่วงละเมิดสิทธิขั้นพื้นฐานของท่านจนเกินสมควร ได้แก่ ห้องพัก ห้องน้ำ ห้องอาบน้ำ หรือสถานที่เพื่อใช้ในการพักผ่อนของผู้ปฏิบัติงาน

4.การเปิดเผยข้อมูลส่วนบุคคลของท่าน

           บริษัทฯจะเก็บรักษาข้อมูลในกล้องวงจรปิดที่เกี่ยวกับท่านไว้เป็นความลับ และจะไม่ทำการเปิดเผย เว้นแต่ กรณีที่บริษัทฯมีความจำเป็นเพื่อให้สามารถบรรลุวัตถุประสงค์ในการเฝ้าระวังสังเกตการณ์ตามที่ได้ระบุในประกาศฉบับนี้ บริษัทฯอาจเปิดเผยข้อมูลในกล้องวงจรปิดแก่ประเภทของบุคคลหรือนิติบุคคล ดังต่อไปนี้

          (1)หน่วยงานที่มีอำนาจหน้าที่ตามที่กฎหมายกำหนด เพื่อช่วยเหลือ สนับสนุนในการบังคับใช้กฎหมาย หรือเพื่อการดำเนินการสืบสวน สอบสวน หรือการดำเนินคดีความต่าง ๆ

          (2)ผู้ให้บริการซึ่งเป็นบุคคลภายนอก เพื่อความจำเป็นในการสร้างความมั่นใจในเรื่องการป้องกันหรือระงับ อันตรายต่อชีวิต ร่างกาย สุขภาพ รวมทั้งทรัพย์สินของท่านหรือบุคคลอื่น 

         (3)อื่น ๆ (หากมี)

5.สิทธิในเจ้าของข้อมูลส่วนบุคคลของท่าน

            พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 มีวัตถุประสงค์เพื่อให้ข้อมูลส่วนบุคคลของท่านอยู่ในความควบคุมของท่านได้มากขึ้น โดยท่านสามารถใช้สิทธิตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 เมื่อบทบัญญัติในส่วนที่เกี่ยวกับสิทธิของเจ้าของข้อมูลส่วนบุคคลมีผลใช้บังคับ ซึ่งมีรายละเอียดดังต่อไปนี้

          (1)สิทธิในการเข้าถึง รับสำเนา และขอให้เปิดเผยที่มาของข้อมูลส่วนบุคคลของท่านที่บริษัทฯเก็บรวบรวมอยู่ เว้นแต่กรณีที่บริษัทฯมีสิทธิปฏิเสธคำขอของท่านตามกฎหมายหรือคำสั่งศาล หรือกรณีที่คำขอของท่านจะมีผลกระทบที่อาจก่อให้เกิดความเสียหายต่อสิทธิและเสรีภาพของบุคคลอื่น 

          (2)สิทธิในการขอแก้ไขข้อมูลส่วนบุคคลของท่านที่ไม่ถูกต้องหรือไม่ครบถ้วน เพื่อให้มีความถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด 

         (3) สิทธิในการขอให้ระงับการใช้ข้อมูลส่วนบุคคลของท่านในกรณีหนึ่งกรณีใด ดังต่อไปนี้ 

          3.1 เมื่ออยู่ในช่วงเวลาที่บริษัทฯทำการตรวจสอบตามคำร้องขอของท่านให้แก้ไขข้อมูลส่วนบุคคลของท่านให้ถูกต้อง สมบูรณ์และเป็นปัจจุบัน

          3.2 ข้อมูลส่วนบุคคลของท่านถูกเก็บรวบรวม ใช้หรือเปิดเผยโดยมิชอบด้วยกฎหมาย

          3.3 เมื่อข้อมูลส่วนบุคคลของท่านหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์บริษัทฯได้แจ้งไว้ในการเก็บรวบรวม แต่ท่านประสงค์ให้บริษัทฯเก็บรักษาข้อมูลนั้นต่อไปเพื่อประกอบการใช้สิทธิตามกฎหมายของท่าน

          3.4 เมื่ออยู่ในช่วงเวลาที่บริษัทฯกำลังพิสูจน์ให้ท่านเห็นถึงเหตุอันชอบด้วยกฎหมายในการเก็บรวบรวม ใช้หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน หรือตรวจสอบความจำเป็นในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านเพื่อประโยชน์สาธารณะ อันเนื่องมาจากการที่ท่านได้ใช้สิทธิคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน

          (4) สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน เว้นแต่กรณีที่บริษัทฯเหตุในการปฏิเสธคำขอของท่านโดยชอบด้วยกฎหมาย (เช่น บริษัทฯสามารถแสดงให้เห็นว่าการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านมีเหตุอันชอบด้วยกฎหมายยิ่งกว่า หรือเพื่อการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องทางกฎหมาย หรือเพื่อประโยชน์สาธารณะตามภารกิจของบริษัทฯ)

6. ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

          เพื่อบรรลุวัตถุประสงค์ของการเฝ้าระวังสังเกตโดยการใช้อุปกรณ์กล้องวงจรปิดตามที่ประกาศนี้กำหนด บริษัทฯจะเก็บรักษาข้อมูลส่วนบุคคลในกล้องวงจรปิดที่เกี่ยวข้องกับท่าน เป็นระยะเวลาประมาณ 10 วัน     นับจากเจ้าหน้าที่ของอาคารได้ทำการตรวจสอบย้อนหลังเรียบร้อยแล้ว       โดยระยะเวลาดังกล่าวเป็นไปตามมาตรฐานการจัดเก็บของบริษัทฯ     ทั้งนี้ เมื่อพ้นระยะเวลาดังกล่าวบริษัทฯจะทำการ ลบ ทำลายข้อมูลส่วนบุคคลของท่านต่อไป

7. การรักษาความมั่นคงปลอดภัยข้อมูลส่วนบุคคล

          บริษัทฯมีมาตรการในการรักษาความมั่นคงปลอดภัยข้อมูลส่วนบุคคลของท่านอย่างเหมาะสม ทั้งในเชิงเทคนิคและการบริหารจัดการ เพื่อป้องกันมิให้ข้อมูลสูญหาย หรือมีการเข้าถึง ลบ ทำลาย ใช้ เปลี่ยนแปลง แก้ไข หรือเปิดเผยข้อมูลส่วนบุคคลโดยไม่ได้รับอนุญาต ซึ่งสอดคล้องกับนโยบายและแนวปฏิบัติด้านความมั่นคงปลอดภัยสารสนเทศ (Information Security Policy) ของบริษัทฯ 

          นอกจากนี้ บริษัทฯได้กำหนดให้มีนโยบายการคุ้มครองข้อมูลส่วนบุคคลขึ้นโดยประกาศให้ทราบกันโดยทั่วทั้งองค์กร พร้อมแนวทางปฏิบัติเพื่อให้เกิดความมั่นคงปลอดภัยในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล โดยธำรงไว้ซึ่งความเป็นความลับ (Confidentiality) ความถูกต้องครบถ้วน (Integrity) และสภาพพร้อมใช้งาน (Availability) ของข้อมูลส่วนบุคคล โดยบริษัทฯได้จัดให้มีการทบทวนนโยบายดังกล่าวรวมถึงประกาศนี้ในระยะเวลาตามที่เหมาะสม

8.ความรับผิดชอบของผู้ควบคุมข้อมูลส่วนบุคคล

            บริษัทฯได้กำหนดให้เจ้าหน้าที่เฉพาะผู้ที่มีอำนาจหน้าที่เกี่ยวข้องในการจัดเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของกิจกรรมการประมวลผลนี้เท่านั้นที่จะสามารถเข้าถึงข้อมูลส่วนบุคคลของท่านได้   โดยบริษัทฯจะดำเนินการให้เจ้าหน้าที่ปฏิบัติตามประกาศนี้อย่างเคร่งครัด

9.การเปลี่ยนแปลงแก้ไขคำประกาศเกี่ยวกับความเป็นส่วนตัว

          ในการปรับปรุงหรือเปลี่ยนแปลงประกาศนี้ บริษัทฯอาจพิจารณาแก้ไขเปลี่ยนแปลงตามที่เห็นสมควร และจะทำการแจ้งให้ท่านทราบผ่านช่องทาง https://www.promratchada.com โดยมีวันที่ของเวอร์ชันล่าสุดกำกับอยู่ตอนท้าย อย่างไรก็ดี บริษัทฯขอแนะนำให้ท่านโปรดตรวจสอบเพื่อรับทราบประกาศฉบับใหม่อย่างสม่ำเสมอ โดยเฉพาะก่อนที่ท่านจะเข้ามาในพื้นที่ของบริษัทฯ      การเข้ามาในพื้นที่ของท่าน ถือเป็นการรับทราบตามข้อตกลงในประกาศนี้ ทั้งนี้ โปรดระงับการเข้าพื้นที่ หากท่านไม่เห็นด้วยกับข้อตกลงในประกาศฉบับนี้ หากท่านยังคงเข้ามาในพื้นที่ต่อไปภายหลังจากที่ประกาศนี้มีการแก้ไขและนำขึ้นประกาศในช่องทางข้างต้นแล้ว จะถือว่าท่านได้รับทราบการเปลี่ยนแปลงดังกล่าวแล้ว
